RADIOCLOTHES ONLINE STORE TERMS AND CONDITIONS
effective from: July 28, 2026
§ 1. General Provisions
- These Terms and Conditions define the rules for using the RadioClothes online store, available at https://radioclothes.com, in particular the rules for placing orders, concluding sales contracts, making payments, making deliveries, the rights and obligations of Customers and the Seller, as well as the rules for filing complaints and exercising the right of withdrawal.

3. These Terms and Conditions have been prepared in accordance with applicable Polish and European Union law, in particular:
- the Civil Code,
- the Act of 30 May 2014 on Consumer Rights,
- the Act of 18 July 2002 on the provision of services by electronic means,
- Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR),
- and other applicable regulations concerning e-commerce.
4. The Terms and Conditions are available free of charge on the Store's website, allowing you to download, save, and print them.
5. Placing an order is conditional upon reviewing and accepting the Terms and Conditions.
§ 2. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the following meanings:
Seller – K-ART STUDIO Bartłomiej Bzymek, operating the RadioClothes online store.
Store – the online store operated at https://radioclothes.com
Customer – a natural person, legal entity, or organizational unit with legal capacity making purchases in the Store.
Consumer – a natural person making a purchase not directly related to their business or professional activity.
Entrepreneur with Consumer Rights – a natural person conducting business activity who is entitled to rights arising from the Consumer Rights Act, in accordance with applicable regulations.
Product – a movable item offered for sale in the Store.
Personalized Product – a product made in accordance with the Customer's individual specifications, in particular one containing embroidery including the first name, last name, call sign, nickname, company name, or other inscription specified by the Customer.
Order – the Customer's declaration of intent aimed at concluding a sales contract.
Sales Agreement – an agreement concluded between the Customer and the Seller via the Store.
§ 3. Terms of Use of the Store
- Using the Store is voluntary.
- To use the Store, you must have:
- a device with internet access,
- a current internet browser,
- an active email address. - The Customer agrees to use the Store in accordance with applicable law, good practice, and the provisions of these Terms and Conditions.
- It is prohibited to provide unlawful content, content that infringes the rights of third parties, or that may disrupt the operation of the Store.
§ 4. Product Information
- The information provided on the Store's website constitutes an invitation to enter into a contract within the meaning of the Civil Code.
- The Seller exercises due diligence to ensure that the descriptions, photographs, and parameters of the Products are accurate.
- Product photos are for illustrative purposes only. Due to the individual settings of the monitor or display of the end device, the actual color of the product or thread color may differ slightly from that presented on the screen.
- In the case of personalized products, minor differences resulting from the embroidery technology, particularly regarding the embroidery's position, dimensions, or thread shade, do not constitute a product defect, provided they do not affect its compliance with the order.
§ 5. Placing Orders
- Orders can be placed 24 hours a day through the Store.
- Orders are placed by:
- selecting the Product,
- selecting available variants,
- completed the required information,
indicate the personalization content, if applicable,
- selected payment and delivery methods,
- and order confirmation. - After placing the order, the Customer receives an e-mail confirming its acceptance.
- The sales contract is concluded upon receipt of the order confirmation by the Customer.
§ 6. Personalized Products
- The Store specializes in the sale of clothing and accessories personalized using computer embroidery.
- Personalization is performed in accordance with the information provided by the Customer when placing the order.
- The Seller does not correct the content of the personalization and is not responsible for any errors resulting from the data provided by the Customer, in particular typos, incorrect markings, call signs, names, surnames, nicknames, or other inscriptions.
- Before completing standard personalization, the Seller does not submit the design for approval, unless the parties individually agree otherwise.
- Once the personalized order has been processed, it may not be possible to change or cancel it.
- Services including embroidery based on Individual designs, logos, or materials provided by the Customer, which require a separate quote or design preparation, are processed outside the online store based on individual arrangements with the Seller and are not covered by these Terms and Conditions.
- The Seller reserves the right to refuse to process orders containing content that is contrary to applicable law, infringes third-party rights, personal rights, copyrights, trademark rights, or generally accepted principles of social coexistence.
§ 7. Prices and Payment Methods
- All Product prices displayed in the Store are expressed in the currency indicated in the Store and include all legally required taxes, unless otherwise expressly stated.
- Shipping costs are not included in the Product price and are indicated to the Customer when placing the Order, before concluding the Sales Agreement.
- The Seller reserves the right to change Product prices, organize promotional campaigns, and introduce and cancel promotions. These changes do not affect Orders placed before their entry into force.
- The Store provides electronic payment methods through payment operators available in the Store. Currently, these include, in particular:
- Shopify Payments
- PayPal
- BLIK
- The availability of individual payment methods may depend on the country of delivery or the Store's configuration.
- Payment is deemed made upon receipt by the Seller of confirmation of its authorization or posting.
§ 8. Delivery and Order Fulfillment
- Orders are shipped within Poland and to countries for which the Store allows Order placement.
- Delivery is carried out via logistics operators cooperating with the Seller. Currently available delivery methods and their costs are presented to the Customer when placing the Order.
- The Order fulfillment time is calculated from the moment the payment is posted or its authorization is confirmed.
- For personalized Products, the fulfillment time may be longer than for standard Products. The estimated fulfillment time is provided in the Product description or when placing the Order.
- If, for reasons beyond the Seller's control, it is not possible to fulfill the Order within the expected time, the Seller will immediately inform the Customer, indicating a new expected completion time or proposing an alternative solution.
- The risk of accidental loss or damage to the Product passes to the Customer upon its delivery to the Customer or a person designated by the Customer.
- The Customer should inspect the shipment upon receipt. If damage occurs during transport, it is recommended to prepare a damage report with the carrier and contact the Seller immediately.
§ 9. Right of Withdrawal
- Consumers and entrepreneurs exercising consumer rights have the right to withdraw from a distance sales contract within 14 days of receipt of the Product, without providing a reason, subject to exceptions arising from applicable law and these Terms and Conditions.
- To exercise the right of withdrawal, the Customer must submit a clear declaration to the Seller by sending it to the following email address: biuro@k-artstudio.pl
- The Customer is obligated to return the Product immediately, no later than 14 days from the date of withdrawal.
- The direct cost of returning the Product is borne by the Customer.
- The returned Product must be appropriately secured for transport. The Customer is responsible for any reduction in the value of the Product resulting from its use beyond what is necessary to establish its nature, characteristics, and functioning.
§ 10. Exclusion of the right to withdraw from the Agreement
- The right to withdraw from the Agreement does not apply in the cases specified in applicable law, in particular with respect to Products manufactured according to the Customer's specifications or intended to meet their individual needs.
- The Products referred to in paragraph 1 include, in particular, clothing and accessories with embroidery made in accordance with the Customer's individual specifications, including, but not limited to:
- first name,
- last name,
- call sign,
- nickname,
- company name,
- individual inscription,
- other personalization elements.
- Personalized Products are not returnable due to a change of mind by the Customer, incorrect size selection, or other circumstances unrelated to the Product's non-conformity with the Agreement.
- Exclusion of the right to withdraw from the Agreement does not limit the Customer's rights under the provisions regarding the Seller's liability for non-conformity of goods with the Agreement.
§ 11. Complaints and Product Conformity with the Agreement
- The Seller is liable to the Consumer and the entrepreneur exercising consumer rights for the lack of conformity of the Product with the Agreement in accordance with applicable law.
- Complaints can be submitted:
- by e-mail: biuro@k-artstudio.pl
- in writing to the Seller's registered office address. - The complaint should include, where possible:
- Order number,
- Customer information,
- description of the identified non-conformity,
- date of its discovery,
- photographic documentation, if possible.
- The lack of photo documentation does not constitute grounds for rejecting the complaint, however, attaching it may expedite the complaint review process.
- The Seller will review the complaint within the timeframe specified by applicable law and inform the Customer about the procedure for its review via email or other agreed means of communication.
- If the complaint is accepted, the Seller will take the actions specified by applicable law, in particular, will bring the Product into compliance with the Agreement through repair or replacement. If this is not possible or involves excessive costs, the Seller will use other measures specified by law.
§ 12. Responsibility for Data Provided by the Customer
- The Customer is fully responsible for the accuracy of the data provided when placing the Order, in particular the content intended for personalizing the Product. The Seller performs personalization according to the content provided by the Customer and is not responsible for errors resulting from:
- typos,
- mispelled names, - surnames, - nicknames, or call signs,
- incorrect numbers or other designations provided by the Customer. - After the personalized Order has been processed, changing the embroidery content or canceling the Order may not be possible.
§ 13. Product Sizes and Nature
- The dimensions of the clothing presented in the Store are approximate and may differ slightly from the actual dimensions of the product, in accordance with the manufacturer's production tolerances.
- Product photos are for illustrative purposes only. The actual appearance of the Product may differ slightly from that shown in the photos due to:
- monitor or display settings,
- lighting conditions during photography,
- differences between production batches of materials and threads
- Permissible technological differences do not constitute grounds for complaint, as long as the Product remains in compliance with the Agreement.
§ 14. Intellectual Property Rights
- All materials posted in the Store, in particular:
- photographs,
- product descriptions,
- graphic designs,
- graphic symbols,
- the RadioClothes logo,
- website layout,
are subject to legal protection.
2. Copying, distributing, or using materials posted in the Store without the prior consent of the Seller is prohibited, except as permitted by applicable law.
§ 15. Personal Data
- The administrator of Customers' personal data is K-ART STUDIO Bartłomiej Bzymek.
- Personal data is processed in accordance with applicable law and the Privacy Policy available on the Store's website.
- Detailed information regarding personal data processing can be found in a separate Privacy Policy.
§ 16. Extrajudicial Dispute Resolution
- Consumers have the option of using extrajudicial means of resolving complaints and pursuing claims, as provided for by applicable law.
- Detailed information on available procedures can be obtained from the relevant consumer protection authorities and on websites operated by relevant public institutions.
- The use of out-of-court dispute resolution methods is voluntary and requires the consent of both parties.
§ 17. Force Majeure
- The Seller shall not be liable for delays or non-performance of the Agreement resulting from circumstances beyond its reasonable control, in particular:
- natural disasters,
- IT infrastructure failures,
- payment operator interruptions,
- carrier delays,
- actions of public administration bodies,
- other events of force majeure.
- In the event of such circumstances, the Seller will inform the Customer of the expected impact on the fulfillment of the Order.
§ 18. Changes to the Terms and Conditions
- The Seller may change the Terms and Conditions in the event of:
- changes in legal regulations,
- changes in the manner of conducting business,
- introduction of new Store functionalities,
- changes in payment or delivery methods,
- need to correct errors or clarify the provisions of the Terms and Conditions. - Amendments to the Terms and Conditions do not affect the rights of Customers arising from Agreements concluded before the effective date of the amendments.
§ 19. Final Provisions
- In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular:
- the Civil Code,
- the Consumer Rights Act,
- the Act on the Provision of Electronic Services,
- the GDPR,
- and other applicable laws.
- If any provision of the Terms and Conditions proves invalid or ineffective, this shall not affect the validity of the remaining provisions.
- The Terms and Conditions are effective from the date of their publication on the Store's website.
